INFORM Consumers Act

The INFORM Consumers Act is a US law that’s designed to protect online marketplaces and their consumers by increasing trust through a stricter mandatory policy to collect, verify, and disclose certain information from high-volume third-party sellers. In simple terms, platforms like eBay or Etsy are required to both verify the legitimacy of high-volume third-party sellers and ensure they sell legitimate, authentic products, and not replicas.

The act applies to sellers who have made 200 or more sales and earned $5,000 or more in the past year. To comply, online marketplaces must collect and verify key seller information, including tax identification numbers, government-issued IDs, and bank account details. Additionally, marketplaces must also provide certain seller information (applies to high-volume sellers with over $20,000 in annual revenue), such as name and contact information, directly to consumers, as a way to ensure better reporting processes in case of suspicious activity that needs to be reported.
