Mississippi Age Verification Law

Mississippi prioritized the online safety of children; this prompted an effort to protect minors from exposure to pornographic content online. Mississippi Governor Tate Reeves, on April 18, 2023, signed the senate bill (SB 2346), also known as “An Act to Regulate Pornographic Media Exposure to Children.

This act mandates websites containing a substantial portion of pornographic content must implement reasonable verification methods to confirm the age of individuals attempting to access such material.

Legislators with the Mississippi Library Association have revised this act to narrow the bill to the most harmful online content.

This Mississippi senate bill (SB 2346), also known as “An Act to Regulate Pornographic Media Exposure to Children” compels commercial enterprises or websites that knowingly post or transmit material harmful to K–12-aged children to verify the age of those attempting to access such content. It specifically targets websites that have a considerable amount of sexual content (pornography). The act stipulates that any entity that performs the required age verification must not retain any identifying information of the individual after access has been granted.

In this situation, the law defines harmful material as stuff that, according to contemporary community standards, appeals to kids’ prurient interests while also being blatantly offensive. It further states that such content must not have significant literary, artistic, political, or scientific value for minors.
